Tenancy in Common<\/h1>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.9.7&#8243; background_size=&#8221;initial&#8221; background_position=&#8221;top_left&#8221; background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>A tenant in common\u2019s interest forms part of his estate on his death and passes according to his will (a disposition or declaration by which the person making it provides for the distribution or administration of his property after his death) or the laws of intestacy (a person dying without a will). The main legislation on intestacy is the\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/73\/\" target=\"_blank\" rel=\"noopener\">Intestates\u2019 Estate Ordinance<\/a>\u00a0,\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/73\/\" target=\"_blank\" rel=\"noopener\">Cap. 73<\/a>\u00a0, Laws of Hong Kong.<\/p>\n<p>A tenancy in common must display unity of possession. A tenant in common is regarded as holding a distinct yet undivided share in the property independently of the other co-owner(s). Each tenant in common holds a separate interest in the property. An adoption in Hong Kong must be effected in accordance with the <a href=\"#\">Adoption Ordinance , Cap. 290<\/a> , Laws of Hong Kong.
