VII. Protection against economic exploitation<\/h1>\n

Article 32 of the Convention recognises the right of the child to be protected from economic exploitation, from performing hazardous work, and from work which interferes with education or which is harmful to health or to their physical, mental, spiritual, moral or social development. States Parties are required to take positive action to provide for a minimum age for employment, to regulate hours of work and conditions of employment and provide appropriate penalties to ensure the effectiveness of Article 32.<\/p>\n

The\u00a0Employment Ordinance<\/a>\u00a0,\u00a0Cap. 57<\/a>\u00a0, the\u00a0Employment of Children Regulations<\/a>\u00a0,\u00a0Cap. 57B<\/a>\u00a0and the\u00a0Employment of Young Persons (Industry) Regulations<\/a>\u00a0,\u00a0Cap. 57C<\/a>\u00a0contain provisions about the employment of children. For the purposes of the\u00a0Employment Ordinance<\/a>\u00a0, the\u00a0Employment of Children Regulations<\/a>\u00a0and the\u00a0Employment of Young Persons (Industry) Regulations<\/a>\u00a0, a child is a person under 15 years of age. A young person is a person who has attained 15 years but not the age of 18 years.<\/p>\n

Adoption is a legal process by which parental rights and responsibilities over a child are transferred from the birth parents to the adoptive parents. An adoption in Hong Kong must be effected in accordance with the Adoption Ordinance , Cap. 290<\/a> , Laws of Hong Kong. The guiding principle in the adoption process is the \u201cbest interests of the child\u201d ( section 8<\/a> of the Adoption Ordinance<\/a> ).<\/p>

Local adoption service in Hong Kong is provided by the Adoption Unit of the Social Welfare Department and three non-governmental organizations, as Accredited Bodies:<\/p>
