II. Child pornography<\/h1>\n

\u201cChild\u201d means a person under 16 years\u2019 of age.<\/p>\n

\u201cChild pornography\u201d is defined as any photograph, film, computer generated image or other visual depiction that is a pornographic depiction of a person who is or is depicted as being a child. Pornographic depiction means a visual depiction:<\/p>\n

  1. \n
      \n
    1. of a person as being engaged in explicit sexual conduct, whether or not the person is in fact engaged in such conduct; or<\/li>\n
    2. that depicts in a sexual manner or context the genitals or anal region of a person or the breast of a female person, but does not include a depiction for a genuine family purpose.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

      The pornography may be by electronic or other means, and includes data stored in a form that is capable of being converted into a photograph, film, image, such as a computer file.<\/p>\n

      It is an offence contrary to\u00a0section 3<\/a>\u00a0of the\u00a0Prevention of Child Pornography Ordinance<\/a>\u00a0(\u00a0Chapter 579<\/a>\u00a0), for any person to:<\/p>\n

      1. \n
          \n
        1. print, make, produce, reproduce, copy, import or export any child pornography,
          (The maximum penalty on\u00a0          conviction on indictment<\/a>\u00a0is a fine of $2,000,000 and imprisonment for 8 years; or on\u00a0summary conviction<\/a>\u00a0a fine of $1,000,000 and imprisonment for 3 years);<\/li>\n
        2. publish any child pornography,
          (The maximum punishment on\u00a0          conviction on indictment<\/a>\u00a0is a fine of $2,000,000 and imprisonment for 8 years; or on\u00a0summary conviction<\/a>\u00a0a fine of $1,000,000 and imprisonment for 3 years);<\/li>\n
        3. possess any child pornography (unless he or she is the only person pornographically depicted in the child pornography),
          (The maximum penalty on\u00a0          conviction on indictment<\/a>\u00a0is a fine of $1,000,000 and imprisonment for 5 years; or on\u00a0summary conviction<\/a>\u00a0a fine of $500,000 and imprisonment for 2 years);<\/li>\n
        4. publish or cause to be published any advertisement that conveys or is likely to be understood as conveying the message that any person has published, publishes or intends to publish any child pornography,
          (The maximum punishment on\u00a0          conviction on indictment<\/a>\u00a0is a fine of $2,000,000 and imprisonment for 8 years; or on\u00a0summary conviction<\/a>\u00a0a fine of $1,000,000 and imprisonment for 3 years.)<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

          A person \u201cpublishes\u201d child pornography if he or she:<\/p>\n

          1. \n
              \n
            1. distributes, circulates, sells, hires, gives or lends the child pornography to another person; or<\/li>\n
            2. shows the child pornography in any manner whatsoever to another person, including publicly displaying the child pornography in any public street or pier, or public garden or any public place where the public are permitted to have access.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

              Adoption is a legal process by which parental rights and responsibilities over a child are transferred from the birth parents to the adoptive parents. An adoption in Hong Kong must be effected in accordance with the Adoption Ordinance , Cap. 290<\/a> , Laws of Hong Kong. The guiding principle in the adoption process is the \u201cbest interests of the child\u201d ( section 8<\/a> of the Adoption Ordinance<\/a> ).<\/p>

              Local adoption service in Hong Kong is provided by the Adoption Unit of the Social Welfare Department and three non-governmental organizations, as Accredited Bodies:<\/p>
