Basic Protection under the Employment Ordinance<\/h2>\n<p>The\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\/\">Employment Ordinance<\/a>\u00a0(\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\/\">Cap. 57<\/a>\u00a0) provides basic protection for employees in an employer-employee relationship. Here is a list of applicable sections:<\/p>\n<ol type=\"1\">\n<li>Prohibition from heavy, hazardous or harmful work (\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\/s15aa.html\">section 15AA<\/a>\u00a0)<\/li>\n<li>Working on rest days (\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\/s19.html\">section 19(1)<\/a>\u00a0)<br \/>\u201c\u2026No employer shall require an employee to work on any of his rest days.\u201d<\/li>\n<li>Annual leave pay (\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\/s41b.html\">section 41B<\/a>\u00a0)<\/li>\n<li>Statutory holiday arrangement (\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\/s39.html\">section 39(4)(a)<\/a>\u00a0)<\/li>\n<li>Holiday pay (\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\/s40.html\">sections 40<\/a>\u00a0,\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\/s40a.html\">40A<\/a>\u00a0,\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\/s41a.html\">41A<\/a>\u00a0)<\/li>\n<li>Severance payment (\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\/cur.html#partva\">Part VA<\/a>\u00a0)<\/li>\n<li>Long service payment (\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/57\/s31r.html\">section 31R<\/a>\u00a0)<\/li>\n<\/ol>\n<h2>B. Minimum Wage Protection<\/h2>\n<p>Employer-employee relationships are protected under the\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/608\/\">Minimum Wage Ordinance<\/a>\u00a0(\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/608\/\">Cap. 608<\/a>\u00a0). With reference to\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/608\/s8.html\">section 8<\/a>\u00a0of the\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/608\/\">Minimum Wage Ordinance<\/a>\u00a0(\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/608\/\">Cap. 608<\/a>\u00a0), \u201cAn employee is entitled to be paid wages in respect of any wage period of not less than the minimum wage.\u201d The statutory minimum wage is enforceable by law and employers who breach it are liable to prosecution.<\/p>\n<h2>C. Protection given by the MPF<\/h2>\n<p>In Hong Kong, employers have to contribute to the employee\u2019s Mandatory Provident Fund. Employees are protected under the\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/485\/\">Mandatory Provident Fund Schemes Ordinance<\/a>.\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/485\/s7a.html\">Section 7A<\/a>\u00a0of the\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/485\/\">Mandatory Provident Fund Schemes Ordinance<\/a>\u00a0(\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/485\/\">Cap. 485<\/a>\u00a0) provides that an employer will have to contribute to the employee\u2019s Mandatory Provident Fund.<\/p>\n<h2>D. Protection given by the Employment Compensation Ordinance<\/h2>\n<p>Employees are protected by the\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/282\/\">Employment Compensation Ordinance<\/a>\u00a0(\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/282\/\">Cap. 282<\/a>\u00a0). This ordinance applies to situations where an employee, during the course of employment, suffers injury or damages. Protection includes no fault compensation, where an employee is entitled to compensation without needing to prove the fault of any party.\u00a0 This ordinance covers \u201cpersonal injury by accident arising out of or in the course of employment\u201d. This Ordinance also covers certain occupational diseases listed in\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/282\/sch2.html\">Schedule 2<\/a>\u00a0of the\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/legis\/ord\/282\/\">Employment Compensation Ordinance<\/a>. Employee\u2019s compensation can cover \u00a0loss of earnings and\/or earning capacity and medical expenses. Employees can also be paid for the costs and maintenance of prosthesis and surgical appliances. Under this ordinance, an employee retains the right to claim for damages in court. An adoption in Hong Kong must be effected in accordance with the <a href=\"#\">Adoption Ordinance , Cap. 290<\/a> , Laws of Hong Kong.
