III. Domestic violence acts: Possible fatal criminal offences<\/h1>\n

A. Murder<\/h2>\n

Depending upon the force used, its consequences, and the abuser\u2019s intention in using that force, the abuser may be charged with murder or manslaughter. Murder is the unlawful killing of a person where the abuser had the intension of killing or causing grievous bodily harm. The abuser who uses violence intending to kill or intending to cause the victim grievous bodily harm therefore commits murder if the victim dies. Murder is a common law offence but punishable under\u00a0section 2<\/a>\u00a0of the\u00a0Offences Against the Person Ordinance<\/a>\u00a0(\u00a0Cap. 212<\/a>\u00a0). The only penalty for murder is imprisonment for life.<\/p>\n

B. Manslaughter<\/h2>\n

Where violence is inflicted with no intent to kill or to cause grievous bodily harm but the victim dies, the abuser may be convicted of manslaughter. Manslaughter is any unlawful killing which is not murder. Inflicting violence is an unlawful act. It is also a dangerous act. If at the same time, it is an act which is likely to injure another person and, inadvertently, that person dies, the abuser is guilty of manslaughter. The punishment for manslaughter is any sentence up to and including life imprisonment.<\/p>\n

Adoption is a legal process by which parental rights and responsibilities over a child are transferred from the birth parents to the adoptive parents. An adoption in Hong Kong must be effected in accordance with the Adoption Ordinance , Cap. 290<\/a> , Laws of Hong Kong. The guiding principle in the adoption process is the \u201cbest interests of the child\u201d ( section 8<\/a> of the Adoption Ordinance<\/a> ).<\/p>

Local adoption service in Hong Kong is provided by the Adoption Unit of the Social Welfare Department and three non-governmental organizations, as Accredited Bodies:<\/p>
