As stalking is not currently a criminal offence in Hong Kong, consideration must be given to protection under existing Hong Kong laws. Criminal offences under the\u00a0Offences Against the Person Ordinance<\/a>\u00a0(\u00a0Cap. 212<\/a>\u00a0), the\u00a0Crimes Ordinance<\/a>\u00a0(\u00a0Cap. 200<\/a>\u00a0), the\u00a0Theft Ordinance<\/a>\u00a0(\u00a0Cap. 210<\/a>\u00a0), the\u00a0Summary Offences Ordinance<\/a>\u00a0(\u00a0Cap. 228<\/a>\u00a0) and the\u00a0Public Order Ordinance<\/a>\u00a0(\u00a0Cap. 245<\/a>\u00a0) may be committed, depending upon the particular facts and the intention of the stalker.<\/p>\n Whether or not to prosecute in a particular case is a matter for the police to decide. Guidelines for the commencement of prosecution are set out in the\u00a0Prosecution Code<\/a>\u00a0, issued on 7th September 2013. The main determining factor for a prosecution is whether the evidence in the particular case shows a reasonable prospect of success.
