XI. Same-Sex Marriage \/ Civil partnership<\/h1>\n

Under the Hong Kong law, marriage shall be a Christian marriage or the civil equivalent of a Christian marriage.\u00a0Section 40<\/a>\u00a0of the\u00a0Marriage Ordinance<\/a>\u00a0(\u00a0Cap. 181<\/a>\u00a0) states that marriage “implies a formal ceremony recognized by law as involving the voluntary union for life of\u00a0\u00a0one man and one woman to the exclusion of all others<\/em>\u00a0“. Therefore, same-sex couples are excluded from the legal institution of marriage, along with the benefits of marriage.<\/p>\n

Civil partnership (or same sex unions) is not recognized in Hong Kong. Under\u00a0section 4<\/a>\u00a0of the\u00a0Marriage Reform Ordinance<\/a>\u00a0, marriage is defined as \u201cthe voluntary union for life of one man with one woman to the exclusion of all others\u2026\u201d<\/p>\n

It is worthy to note that under the UK Civil Partnership Act of 2004, British Nationals and BNO citizens already have the right to register as civil partners, meaning Hong Kong residents holding BNO status actually possess the right to register for civil partnership under UK law. However, they cannot register for civil partnerships in Hong Kong as the HKSAR government raised \u201cstrong objections\u201d with the British consulate-general. Therefore, despite their \u201ccitizenship\u201d, Hong Kong people do not have the British constitutional rights within Hong Kong.<\/p>\n

Adoption is a legal process by which parental rights and responsibilities over a child are transferred from the birth parents to the adoptive parents. An adoption in Hong Kong must be effected in accordance with the Adoption Ordinance , Cap. 290<\/a> , Laws of Hong Kong. The guiding principle in the adoption process is the \u201cbest interests of the child\u201d ( section 8<\/a> of the Adoption Ordinance<\/a> ).<\/p>

Local adoption service in Hong Kong is provided by the Adoption Unit of the Social Welfare Department and three non-governmental organizations, as Accredited Bodies:<\/p>
