rel=\"noopener\">6A\u689d<\/a>\u00a0\u884c\u4f7f\u6b0a\u529b\uff0c\u4ee5\u53ca\u82e5\u884c\u4f7f\u8a72\u7b49\u6b0a\u529b\u5247\u61c9\u63a1\u53d6\u4f55\u7a2e\u65b9\u5f0f\u6642\uff0c\u6709\u8cac\u4efb\u9867\u53ca\u5a5a\u59fb\u96d9\u65b9\u7684\u884c\u70ba\u548c\u6848\u4ef6\u7684\u6240\u6709\u60c5\u6cc1\uff0c\u5305\u62ec\u9867\u53ca\u4e0b\u5217\u4e8b\u5b9c\u2500<\/p>\n<ol style=\"list-style-type: lower-alpha;\">\n<li>\u5a5a\u59fb\u96d9\u65b9\u5404\u5225\u64c1\u6709\u7684\u6216\u5728\u53ef\u9810\u898b\u7684\u5c07\u4f86\u76f8\u7576\u53ef\u80fd\u64c1\u6709\u7684\u6536\u5165\u3001\u8b00\u751f\u80fd\u529b\u3001\u8ca1\u7522\u53ca\u5176\u4ed6\u7d93\u6fdf\u4f86\u6e90\uff1b<\/li>\n<li>\u5a5a\u59fb\u96d9\u65b9\u5404\u81ea\u9762\u5c0d\u7684\u6216\u5728\u53ef\u9810\u898b\u7684\u5c07\u4f86\u76f8\u7576\u53ef\u80fd\u9762\u5c0d\u7684\u7d93\u6fdf\u9700\u8981\u3001\u8ca0\u64d4\u53ca\u8cac\u4efb\uff1b<\/li>\n<li>\u8a72\u5bb6\u5ead\u5728\u5a5a\u59fb\u7834\u88c2\u524d\u6240\u4eab\u6709\u7684\u751f\u6d3b\u6c34\u5e73\uff1b<\/li>\n<li>\u5a5a\u59fb\u96d9\u65b9\u5404\u5225\u7684\u5e74\u9f61\u548c\u5a5a\u59fb\u7684\u6301\u7e8c\u671f\uff1b<\/li>\n<li>\u5a5a\u59fb\u7684\u4efb\u4f55\u4e00\u65b9\u662f\u5426\u5728\u8eab\u9ad4\u4e0a\u6216\u7cbe\u795e\u4e0a\u6709\u6b98\u969c\uff1b<\/li>\n<li>\u5a5a\u59fb\u96d9\u65b9\u5404\u5225\u70ba\u5bb6\u5ead\u7684\u798f\u5229\u800c\u4f5c\u51fa\u7684\u8ca2\u737b\uff0c\u5305\u62ec\u7531\u65bc\u7167\u6599\u5bb6\u5ead\u6216\u7167\u9867\u5bb6\u4eba\u800c\u4f5c\u51fa\u7684\u8ca2\u737b\uff1b<\/li>\n<li>\u5982\u5c6c\u96e2\u5a5a\u6216\u5a5a\u59fb\u7121\u6548\u7684\u6cd5\u5f8b\u7a0b\u5e8f\uff0c\u5247\u9867\u53ca\u5a5a\u59fb\u7684\u4efb\u4f55\u4e00\u65b9\u56e0\u5a5a\u59fb\u89e3\u9664\u6216\u5ee2\u6b62\u800c\u5c07\u6703\u55aa\u5931\u6a5f\u6703\u6240\u7372\u5f97\u7684\u4efb\u4f55\u5229\u76ca(\u4f8b\u5982\u9000\u4f11\u91d1)\u7684\u50f9\u503c\u3002\u300d<\/li>\n<\/ol>\n<p>\u4e0a\u8ff0\u689d\u6587\u662f\u6839\u64da\u82f1\u570b\u57281973\u5e74\u9812\u5e03\u7684\u300a\u5a5a\u59fb\u8a34\u8a1f\u6cd5\u300b\u7b2c25(1)\u689d\u53ca1984\u5e74\u9812\u5e03\u7684\u300a\u5a5a\u59fb\u53ca\u5bb6\u5ead\u7a0b\u5e8f\u6cd5\u300b\u7b2c3\u689d\u800c\u8a02\u7acb\u3002<\/p>\n<p>\u82f1\u570b\u4e0a\u8b70\u9662\u5be9\u7406\u00a0<em>White v White [2001]<\/em>\u00a0\u4e00\u6848\uff0c\u5c31\u5206\u914d\u8ca1\u7522\u6240\u4f5c\u7684\u88c1\u6c7a\u751a\u5177\u4ee3\u8868\u6027\uff0c\u52a0\u4e0a\u5176\u5f8c\u5be9\u7406\u7684\u00a0<em>Miller v Miller<\/em>\u00a0\u548c\u00a0<em>McFarlane v McFarlane [2006]<\/em>\u00a0\u5169\u5b97\u6848\u4ef6\uff0c\u6210\u70ba\u5206\u914d\u8ca1\u7522\u6848\u7684\u91cd\u8981\u6848\u4f8b\u3002\u81ea\u6b64\uff0c\u5982\u6848\u4e2d\u7684\u96e2\u5a5a\u592b\u5a66\u6c92\u6709\u5354\u8b70\uff0c\u6cd5\u5ead\u4fbf\u6703\u4ee5\u516c\u5e73\u539f\u5247\u6c7a\u5b9a\u5982\u4f55\u5206\u914d\u8ca1\u7522\u3002<\/p>\n<p>\u70ba\u5bb6\u5ead\u4f5c\u8ca1\u653f\u4ee5\u5916\u7684\u4ed8\u51fa\u662f\u4e00\u9805\u91cd\u8981\u56e0\u7d20\uff0c\u592b\u5a66\u4e8c\u4eba\u5728\u5a5a\u59fb\u95dc\u4fc2\u4e2d\u64c1\u6709\u76f8\u540c\u5730\u4f4d\u4ea6\u662f\u5206\u914d\u8ca1\u7522\u7684\u539f\u5247\uff0c\u56e0\u6b64\uff0c\u51fa\u767c\u9ede\u5c07\u6703\u662f\u628a\u8ca1\u7522\u5e7e\u4e4e\u5e73\u5747\u5206\u7d66\u5169\u4eba\u3002<\/p>\n<p>\u4e0a\u8a34\u5ead\u5728\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/cases\/hkca\/2008\/74.html\" target=\"_blank\" rel=\"noopener\">DD v LKW<\/a>\u00a0\u4e00\u6848\u4e2d\u4ea6\u63d0\u5230\u76f8\u95dc\u539f\u5247\uff1a<br \/>\n\u300c(1) \u5982\u679c\u96d9\u65b9\u53ea\u6709\u6709\u9650\u7684\u7d93\u6fdf\u4f86\u6e90\uff0c\u5728\u5927\u591a\u6578\u7684\u9019\u7a2e\u6848\u4ef6\u4e2d\uff0c\u63a2\u8a0e\u5982\u4f55\u505a\u5230\u516c\u5e73\uff0c\u61c9\u96c6\u4e2d\u5728\u5982\u4f55\u5206\u914d\u96d9\u65b9\u7684\u8cc7\u7522\u4ee5\u61c9\u4ed8\u4ed6\u5011\u5728\u5c45\u4f4f\u53ca\u7d93\u6fdf\u4e0a\u7684\u9700\u8981\u3002\u6cd5\u5ead\u53ef\u80fd\u9700\u8981\u4f5c\u51fa\u5b9a\u671f\u4ed8\u6b3e\u4ee4\uff0c\u4ee5\u5f4c\u88dc\u53ef\u7528\u8cc7\u7522\u7684\u4e0d\u8db3\u3002<br \u5982\u679c\u5728\u6eff\u8db3\u96d9\u65b9\u5373\u6642\u7684\u5c45\u4f4f\u53ca\u7d93\u6fdf\u9700\u8981\u5f8c\u4ecd\u6709\u5269\u9918\u7684\u53ef\u7528\u8cc7\u7522\u7684\u8a71\uff0c\u5269\u9918\u7684\u61c9\u4e88\u5e73\u5747\u5206\u914d\uff0c\u9664\u975e\u6709\u597d\u7684\u7406\u7531\u4e0d\u9019\u6a23\u505a\u3002\u9019\u7a2e\u505a\u6cd5\u4e0d\u50c5\u50c5\u9069\u7528\u65bc\u300e\u5de8\u6b3e\u6848\u4ef6\u300f\uff0c\u5982\u679c\u6848\u4ef6\u4e2d\uff0c\u5728\u6eff\u8db3\u96d9\u65b9\u9700\u8981\u5f8c\u4ecd\u6709\u5269\u9918\u8cc7\u7522\u53ef\u7528\u7684\uff0c\u4e5f\u53ef\u9069\u7528\u3002<br \/>\n(3) \u6709\u95dc\u63a2\u8a0e\u61c9\u5206\u5169\u500b\u968e\u6bb5\u9032\u884c\uff1a<br \/>\n\u9996\u5148\uff0c\u8a08\u7b97\u96d9\u65b9\u7684\u53ef\u7528\u8cc7\u7522\uff0c\u5982\u8ca1\u7522\u3001\u6536\u5165\uff08\u5305\u62ec\u8b00\u751f\u80fd\u529b\uff09\u548c\u96d9\u65b9\u73fe\u6709\u53ca\u5728\u53ef\u898b\u672a\u4f86\u76f8\u7576\u53ef\u80fd\u64c1\u6709\u7684\u7d93\u6fdf\u4f86\u6e90\u3002<br \/>\n\u5176\u6b21\uff0c\u5206\u914d\u9019\u4e9b\u8cc7\u7522\u6642\u53c3\u8003\u4e09\u9805\u539f\u5247\uff1a\u9700\u8981\u539f\u5247\uff08\u5ee3\u7fa9\u89e3\u91cb\uff09\u3001\u88dc\u511f\u539f\u5247\u53ca\u5206\u4eab\u539f\u5247\u3002\u9019\u4e9b\u539f\u5247\u5747\u53ef\u5f9e\u00a0<a rel=\"noopener\">\u7b2c7(1)(a)-(g)\u689d<\/a>\u00a0\u5217\u51fa\u7684\u6bcf\u4e00\u9805\uff0c\u5747\u53ef\u6b78\u7d0d\u5728\u9019\u4e09\u9805\u539f\u5247\u7684\u67d0\u4e00\u9805\u4e0b\u3002\u300d<\/p>\n<p>\u4e0d\u904e\uff0c\u4e0a\u8a34\u5ead\u5176\u5f8c\u5728\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/cases\/hkca\/2009\/180.html\" target=\"_blank\" rel=\"noopener\">W v
