\u5a5a\u59fb\u5354\u8b70\u66f8\u7684\u6cd5\u5f8b\u5730\u4f4d<\/h2>\n<p>\u592b\u5a66\u5728\u5206\u5c45\u5f8c\u6216\u5206\u5c45\u671f\u9593\u8a02\u5b9a\u7684\u5354\u8b70\u66f8\uff0c\u7a31\u70ba\u300c\u5206\u5c45\u5354\u8b70\u66f8\u300d\u3002\u6839\u64da\u9999\u6e2f\u6cd5\u4f8b<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/\" target=\"_blank\" rel=\"noopener\">\u7b2c192\u7ae0\u300a\u5a5a\u59fb\u6cd5\u5f8b\u7a0b\u5e8f\u8207\u8ca1\u7522\u689d\u4f8b\u300b<\/a>\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/s14.html\" target=\"_blank\" href=\"http:\/\/www.hklii.hk\/eng\/hk\/cases\/hkca\/2007\/208.html\" target=\"_blank\" rel=\"noopener\">\u00a0L v C<\/a>\u4e00\u6848\u4e2d\uff0c\u78ba\u8a8d\u9664\u975e\u51fa\u73fe\u7121\u6cd5\u9810\u8a08\u7684\u8feb\u5207\u60c5\u6cc1\uff0c\u5426\u5247\u5206\u5c45\u5354\u8b70\u66f8\u5fc5\u9808\u4e88\u4ee5\u9075\u5b88\u3002<\/p>\n<p>\u4e0d\u904e\uff0c\u5982\u592b\u5a66\u65bc\u5206\u5c45\u524d\u4fbf\u8a02\u5b9a\u5354\u8b70\uff0c\u9019\u7a2e\u5354\u8b70\u53ea\u5c6c\u65bc\u5206\u5c45\u524d\u7684\u5a5a\u5f8c\u5354\u8b70\u66f8\uff0c\u8207<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/\" target=\"_blank\" rel=\"noopener\">\u300a\u5a5a\u59fb\u6cd5\u5f8b\u7a0b\u5e8f\u8207\u8ca1\u7522\u689d\u4f8b\u300b<\/a>\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/s14.html\" target=\"_blank\" rel=\"noopener\">\u7b2c14\u689d<\/a>\u4ee5\u4e0b\u7684\u5206\u5c45\u5354\u8b70\u66f8\u4e0d\u540c\u3002\u6cd5\u5ead\u8655\u7406\u6b64\u985e\u5354\u8b70\u66f8\u6642\uff0c\u5c07\u6703\u8207\u8655\u7406\u5a5a\u524d\u5354\u8b70\u66f8\u4e00\u6a23\uff0c\u4f9d\u5f9e\u300cRadmacher\u539f\u5247\u300d\u4f5c\u51fa\u8003\u616e\uff0c\u7a0d\u5f8c\u5c07\u6703\u8a73\u8ff0\u3002<\/p>\n<p>\u6cd5\u5ead\u5728\u96e2\u5a5a\u6848\u4ef6\u4e2d\uff0c\u5982\u9808\u6839\u64da<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/\">\u300a\u5a5a\u59fb\u6cd5\u5f8b\u7a0b\u5e8f\u8207\u8ca1\u7522\u689d\u4f8b\u300b<\/a>\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/192\/s7.html\">\u7b2c7(1)\u689d<\/a>\u8655\u7406\u6d89\u53ca\u9644\u5c6c\u6fdf\u52a9\u53ca\u5206\u914d\u8ca1\u7522\u7684\u4e8b\u5b9c\u6642\uff0c\u6703\u8003\u616e\u300c\u6848\u4ef6\u7684\u60c5\u6cc1\u300d\u53ca\u96d9\u65b9\u7684\u300c\u884c\u70ba\u300d\uff0c\u5a5a\u59fb\u5354\u8b70\uff08\u5206\u5c45\u5354\u8b70\u9664\u5916\uff09\u7684\u5167\u5bb9\u53ef\u6210\u70ba\u8003\u616e\u4e4b\u5217\uff0c\u6cd5\u5ead\u53ef\u80fd\u6703\u63a1\u7d0d\u90e8\u5206\u6216\u5168\u90e8\u5167\u5bb9\u3002<\/p>\n<p>\u6cd5\u5ead\u6c7a\u5b9a\u662f\u5426\u4f9d\u5f9e\u5a5a\u59fb\u5354\u8b70\u66f8\u767c\u51fa\u76f8\u61c9\u547d\u4ee4\u6642\uff0c\u516c\u5e73\u539f\u5247\u5c07\u662f\u91cd\u8981\u7684\u8003\u616e\u56e0\u7d20\u3002\u4ee5\u82f1\u570b\u70ba\u4f8b\uff0c\u5982\u679c\u96d9\u65b9\uff1a<\/p>\n<ol type=\"1\">\n<li>\u6709\u8b49\u64da\u986f\u793a\u4ed6\u5011\u660e\u767d\u5354\u8b70\u7684\u689d\u6b3e\uff1b<\/li>\n<li>\u66fe\u5fb5\u6c42\u7368\u7acb\u7684\u6cd5\u5f8b\u610f\u898b\uff1b<\/li>\n<li>\u5982\u5be6\u4ea4\u4ee3\u6240\u6709\u8ca1\u653f\u72c0\u6cc1\uff1b<\/li>\n<li>\u81ea\u9858\u7c3d\u7f72\u5354\u8b70\uff0c\u4e0d\u66fe\u53d7\u58d3\uff1b<\/li>\n<li>\u6c92\u6709\u5805\u6301\u8655\u65bc\u4e3b\u5c0e\uff1b<\/li>\n<\/ol>\n<p>\u800c\u6709\u95dc\u5354\u8b70\u7684\u689d\u6b3e\u516c\u5e73\uff0c\u7576\u5730\u6cd5\u5ead\u5f88\u53ef\u80fd\u6703\u6309\u7167\u5a5a\u59fb\u5354\u8b70\u66f8\u7684\u689d\u6b3e\uff0c\u8981\u6c42\u5354\u8b70\u96d9\u65b9\u9075\u5f9e\u3002<\/p>\n<p>\u4ee5\u4e0a\u53ea\u5c6c\u57fa\u672c\u6307\u5f15\uff0c\u4e26\u4e0d\u4ee3\u8868\u5168\u90e8\u539f\u5247\u3002\u9664\u975e\u56e0\u61c9\u73fe\u5be6\u60c5\u6cc1\u8981\u6c42\u96d9\u65b9\u9075\u5b88\u5354\u8b70\u7d55\u4e0d\u516c\u5e73\uff0c\u5426\u5247\u53ea\u8981\u96d9\u65b9\u8a02\u7acb\u5354\u8b70\u6642\uff0c\u5b8c\u5168\u660e\u767d\u5354\u8b70\u689d\u6b3e\u7684\u542b\u610f\uff0c\u4e26\u81ea\u9858\u7c3d\u7f72\uff08\u53c3\u8003\u82f1\u570b\u6848\u4f8bRadmacher v Grantino\uff09\uff0c\u6cd5\u5ead\u5fc5\u6703\u5bb9\u8a31\u57f7\u884c\u5a5a\u59fb\u5354\u8b70\uff0c\u767c\u63ee\u5354\u8b70\u689d\u6b3e\u7684\u539f\u610f\u3002<\/p>\n<p>\u5728\u9999\u6e2f\uff0c\u7d42\u5be9\u6cd5\u9662\u5728\u00a0<em>SPH v SA<\/em>\u00a0\u4e00\u6848\u4e2d\u63a1\u7d0d\u00a0<em>Radmacher\u00a0<\/em>\u70ba\u826f\u597d\u6cd5\u5f8b\u3002<\/p>\n<h2>B.\u5a5a\u524d\u5354\u8b70\u66f8\u53ca\u516c\u5171\u653f\u7b56<\/h2>\n<p>\u793e\u6703\u4e00\u76f4\u8a8d\u70ba\uff0c\u4efb\u4f55\u8207\u96e2\u5a5a\u5973\u5b50\u53ca\u5176\u5b50\u5973\u6b0a\u76ca\u76f8\u95dc\u7684\u6cd5\u4f8b\u689d\u6587\uff0c\u5747\u727d\u6d89\u516c\u773e\u5229\u76ca\uff0c\u56e0\u6b64\uff0c\u5a5a\u524d\u5354\u8b70\u66f8\u4e00\u76f4\u88ab\u8996\u4f5c\u6709\u9055\u516c\u5171\u653f\u7b56\u3002\u82f1\u570b\u6848\u4f8bBennett v Bennett\u4fbf\u986f\u793a\uff0c\u6cd5\u5ead\u8a8d\u70ba\u592b\u5a66\u96e2\u5a5a\u5f8c\uff0c\u7537\u65b9\u5982\u6709\u7d93\u6fdf\u80fd\u529b\u652f\u6301\u5973\u65b9\u53ca\u5b50\u5973\u7684\u751f\u6d3b\uff0c\u5973\u65b9\u53ca\u5176\u5b50\u5973\u4fbf\u4e0d\u61c9\u4f9d\u9760\u653f\u5e9c\u6216\u6148\u5584\u5718\u9ad4\u7684\u63f4\u52a9\u751f\u6d3b\uff0c\u4ee5\u7b26\u5408\u516c\u773e\u5229\u76ca\u3002<\/p>\n<p>\u8209\u4f8b\u8aaa\uff0c\u5982\u7c3d\u8a02\u5a5a\u524d\u5354\u8b70\u7684\u5176\u4e2d\u4e00\u65b9\u5728\u7c3d\u7f72\u524d\u6c92\u6709\u5982\u5be6\u62ab\u9732\u6240\u6709\u4e8b\u5be6\uff0c\u96d9\u65b9\u96e2\u5a5a\u5f8c\uff0c\u5973\u65b9\u56e0\u5354\u8b70\u8b8a\u5f97\u6349\u895f\u898b\u8098\uff0c\u6709\u95dc\u5354\u8b70\u4fbf\u6709\u9055\u516c\u5171\u653f\u7b56\u3002\u53e6\u4e00\u4f8b\u5b50\u662f\uff0c\u5982\u96d9\u65b9\u7684\u7d93\u6fdf\u72c0\u6cc1\u65bc\u5a5a\u5f8c\u6709\u91cd\u5927\u6539\u8b8a\uff0c\u4e0d\u8ad6\u8f49\u8b8a\u5b70\u597d\u5b70\u58de\uff0c\u4ed6\u5011\u7576\u521d\u8a02\u7acb\u7684\u5a5a\u524d\u5354\u8b70\u4fbf\u53ef\u80fd\u4e0d\u518d\u7b26\u5408\u516c\u5e73\u539f\u5247\uff0c\u6216\u53ef\u80fd\u4e0d\u518d\u53cd\u6620\u96d9\u65b9\u65bc\u5a5a\u5f8c\u7684\u751f\u6d3b\u6c34\u5e73\u3002<\/p>\n<p>\u53ca\u5f8c\u81f3\u5be9\u7406Radmacher\u4e00\u6848\u6642\uff0c\u7576\u6642\u82f1\u570b\u6cd5\u5ead\u6307\u51fa\uff0c\u5a5a\u524d\u5354\u8b70\u4e26\u6c92\u6709\u9055\u80cc\u516c\u5171\u653f\u7b56\u3002\u4e0d\u904e\uff0c\u82f1\u570b\u6cd5\u5ead\u7684\u88c1\u6c7a\u5c0d\u9999\u6e2f\u6cd5\u5ead\u4f86\u8aaa\uff0c\u53ea\u80fd\u8d77\u53c3\u8003\u4f5c\u7528\u3002\u518d\u8005\uff0c\u5a5a\u524d\u5354\u8b70\u4ea6\u4e0d\u80fd\u7981\u6b62\u4efb\u4f55\u4eba\u5411\u6cd5\u9662\u7533\u8acb\u547d\u4ee4\uff0c\u4ee5\u89e3\u6c7a\u8207\u8ca1\u52d9\u76f8\u95dc\u7684\u554f\u984c\u3002\u5728\u9999\u6e2f\uff0c\u7d42\u5be9\u6cd5\u9662\u5728\u00a0<em>SPH v SA<\/em>\u00a0(2014) 17 HKCFAR 364
