rel=\"noopener\">\u7b2c23\u689d<\/a>\u00a0\u3002\u689d\u4f8b\u6307\u51fa\uff0c\u4efb\u4f55\u4eba\u4ee5\u606b\u5687\u7684\u65b9\u5f0f\u4f5c\u51fa\u4e0d\u7576\u8981\u6c42\uff0c\u70ba\u4e86\u4f7f\u81ea\u5df1\u6216\u53e6\u4e00\u4eba\u7372\u76ca\uff0c\u6216\u610f\u5716\u4f7f\u53e6\u4e00\u4eba\u906d\u53d7\u640d\u5931\uff0c\u5373\u5c6c\u72af\u7f6a\u3002\u51e1\u4ee5\u606b\u5687\u65b9\u5f0f\u4f5c\u51fa\u8981\u6c42\u90fd\u5c6c\u4e0d\u7576\uff0c\u9664\u975e\u4f5c\u51fa\u8981\u6c42\u7684\u4eba\u5728\u63d0\u51fa\u8981\u6c42\u6642\uff0c\u76f8\u4fe1\u81ea\u5df1\u6709\u5408\u7406\u7406\u7531\u63d0\u51fa\u8a72\u8981\u6c42\uff0c\u540c\u6642\uff0c\u4f7f\u7528\u606b\u5687\u53ea\u662f\u52a0\u5f37\u63d0\u51fa\u8981\u6c42\u7684\u9069\u7576\u624b\u6bb5\u3002\u52d2\u7d22\u7f6a\u4e00\u7d93\u5b9a\u7f6a\uff0c\u53ef\u88ab\u5224\u76e310\u5e74\u3002<\/p>\n<p>\u5982\u679c\u6709\u4eba\u628a\u81ea\u5df1\u8207\u53d7\u5bb3\u4eba\u7684\u6027\u4ea4\u904e\u7a0b\u62cd\u4e0b\u4f86\uff0c\u4e26\u5c07\u7247\u6bb5\u76f4\u63a5\u6216\u901a\u904e\u4efb\u4f55\u8cc7\u8a0a\u548c\u79d1\u6280\u7cfb\u7d71\u50b3\u9001\u7d66\u53d7\u5bb3\u4eba\uff0c\u5a01\u8105\u8981\u516c\u958b\u7247\u6bb5\uff0c\u85c9\u6b64\u8981\u6c42\u8207\u5c0d\u65b9\u6027\u4ea4\u6216\u7d22\u53d6\u91d1\u9322\uff0c\u9019\u5c31\u5c6c\u65bc\u52d2\u7d22\u3002\u5176\u4e2d\uff0c\u5728\u00a0<a href=\"http:\/\/www.hklii.hk\/eng\/hk\/cases\/hkdc\/2011\/1208.html\" target=\"_blank\" rel=\"noopener\">\u9999\u6e2f\u7279\u5340\u653f\u5e9c\u8a34\u9f4a\u7f8e\u7fa4\u6848<\/a>\u00a0\uff0c\u88ab\u544a\u9f4a\u7f8e\u7fa4\u8a8d\u7f6a\u5f8c\u88ab\u5224\u56da\u4e8c\u5341\u500b\u6708\u3002\u6848\u60c5\u6307\uff0c\u9f4a\u8207\u53d7\u5bb3\u4eba\u6027\u4ea4\u5f8c\uff0c\u5411\u53d7\u5bb3\u4eba\u767c\u9001\u624b\u6a5f\u77ed\u8a0a\uff0c\u8981\u6c42\u91d1\u9322\u3002\u5728\u53e6\u4e00\u500b\u624b\u6a5f\u77ed\u8a0a\u4e2d\uff0c\u5247\u8868\u793a\u53ef\u5c07\u5169\u4eba\u7684\u89aa\u5bc6\u7247\u6bb5\u300c\u516c\u8af8\u65bc\u4e16\u300d\u3002\u6848\u4ef6\u5224\u5211\u6642\uff0c\u66ab\u59d4\u5340\u57df\u6cd5\u9662\u6cd5\u5b98\u675c\u6d69\u6210\u6307\u51fa\uff0c\u6848\u4ef6\u6709\u5169\u500b\u52a0\u5211\u56e0\u7d20\u3002\u9996\u5148\uff0c\u88ab\u544a\u4e26\u975e\u7a7a\u53e3\u8b1b\u767d\u8a71\uff0c\u5979\u9810\u5148\u9304\u5f71\u81ea\u5df1\u8207\u53d7\u5bb3\u4eba\u7684\u89aa\u5bc6\u7247\u6bb5\uff1b\u5176\u6b21\uff0c\u88ab\u544a\u5411\u53d7\u5bb3\u4eba\u63da\u8a00\u8981\u628a\u7247\u6bb5\u901a\u904e\u96fb\u8166\u767c\u4f48\uff0c\u5fc5\u4ee4\u53d7\u5bb3\u4eba\u9a5a\u614c\uff0c\u6709\u5e38\u8b58\u7684\u4eba\u90fd\u77e5\u9053\u4e92\u806f\u7db2\u4e0d\u53d7\u9650\u5236\uff0c\u4e00\u65e6\u628a\u8cc7\u6599\u4e0a\u8f09\uff0c\u4fbf\u96e3\u4ee5\u522a\u9664\u3002<\/p>\n<p>\u672c\u6848\u6d89\u53ca\u88ab\u544a\u5411\u53d7\u5bb3\u4eba\u7d22\u53d6\u91d1\u9322\uff0c\u4f46\u82e5\u7e8f\u64fe\u8005\u4ee5\u66b4\u529b\u5a01\u8105\u53d7\u5bb3\u4eba\uff0c\u540c\u6a23\u4ea6\u7b97\u52d2\u7d22\u3002\u8b6c\u5982\u8aaa\uff0c\u7528\u6b66\u529b\u5a01\u8feb\u53d7\u5bb3\u4eba\u8207\u7e8f\u64fe\u8005\u6027\u4ea4\u3002\u540c\u6a23\u800c\u8a00\uff0c\u5982\u679c\u7e8f\u64fe\u8005\u5a01\u8105\u8981\u50b7\u5bb3\u53d7\u5bb3\u4eba\u5bb6\u5c6c\u3001\u640d\u5bb3\u53d7\u5bb3\u4eba\u7684\u8ca1\u7522\u6216\u53d7\u5bb3\u4eba\u5bb6\u5c6c\u7684\u8ca1\u7522\uff0c\u4ee5\u5716\u8feb\u4f7f\u53d7\u5bb3\u4eba\u8207\u81ea\u5df1\u898b\u9762\u6216\u6027\u4ea4\uff0c\u4ea6\u7b97\u662f\u52d2\u7d22\u3002\u7531\u65bc\u53d7\u5bb3\u4eba\u662f\u906d\u53d7\u5a01\u8feb\u4e4b\u4e0b\u624d\u9806\u61c9\u8981\u6c42\u6027\u4ea4\uff0c\u7e8f\u64fe\u8005\u4ea6\u6709\u6a5f\u6703\u88ab\u63a7\u5f37\u59e6\uff0c\u89f8\u72af\u00a0<a \u5165\u5c4b\u72af\u6cd5\u7f6a<\/h2>\n<p>\u5165\u5c4b\u72af\u6cd5\u7f6a\u9055\u53cd\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/210\" target=\"_blank\" rel=\"noopener\">\u300a\u76dc\u7aca\u7f6a\u689d\u4f8b\u300b<\/a>\u00a0<a href=\"http:\/\/www.hklii.hk\/chi\/hk\/legis\/ord\/210\/s11.html\" target=\"_blank\" rel=\"noopener\">\u7b2c11\u689d<\/a>\u00a0\u3002\u4efb\u4f55\u4eba\u5982\u4fb5\u5165\u5efa\u7bc9\u7269\u6216\u5176\u90e8\u4efd\uff0c\u4ee5\u5716\u5077\u7aca\u5efa\u7bc9\u7269\u5167\u7684\u6771\u897f\u3001\u6216\u9020\u6210\u5efa\u7bc9\u7269\u5167\u4efb\u4f55\u4eba\u7684\u8eab\u9ad4\u53d7\u5230\u56b4\u91cd\u50b7\u5bb3\uff0c\u6216\u5f37\u59e6\u5728\u8a72\u8655\u7684\u5a66\u5973\uff0c\u6216\u975e\u6cd5\u640d\u58de\u5efa\u7bc9\u7269\u6216\u5167\u88e1\u7684\u4efb\u4f55\u6771\u897f\uff0c\u5373\u5c6c\u72af\u5165\u5c4b\u72af\u6cd5\u7f6a\u3002\u4e00\u7d93\u5b9a\u7f6a\uff0c\u53ef\u88ab\u5224\u56da14\u5e74\u3002<\/p>\n<p>\u4fb5\u5165\u8005\u662f\u6307\u4efb\u4f55\u4eba\u5728\u672a\u7d93\u51c6\u8a31\u6216\u6c92\u6709\u4efb\u4f55\u5408\u6cd5\u7406\u64da\u4e0b\uff0c\u64c5\u81ea\u9032\u5165\u5efa\u7bc9\u7269\u5167\u3002\u9032\u5165\u5efa\u7bc9\u7269\u6642\uff0c\u672a\u5fc5\u4e00\u5b9a\u8981\u6d89\u53ca\u4f7f\u7528\u6b66\u529b\u3002\u5728\u6c92\u6709\u4efb\u4f55\u6b0a\u5229\u4e0b\uff0c\u7372\u5f97\u5efa\u7bc9\u7269\u7684\u9470\u5319\u4e26\u9032\u5165\u8a72\u8655\uff0c\u6216\u5728\u672a\u7d93\u8a31\u53ef\uff0c\u901a\u904e\u5efa\u7bc9\u7269\u672a\u95dc\u4e0a\u7684\u9580\u7a97\u9032\u5165\u8a72\u8655\uff0c\u90fd\u7b97\u662f\u975e\u6cd5\u5165\u4fb5\u3002<\/p>\n<p>\u975e\u6cd5\u640d\u58de\u6771\u897f\uff0c\u53ef\u4ee5\u5305\u62ec\u5c0e\u81f4\u5efa\u7bc9\u7269\u5167\u7684\u96fb\u8166\u5931\u9748\uff0c\u975e\u6cd5\u522a\u9664\u96fb\u8166\u7a0b\u5f0f\uff0c\u6216\u975e\u6cd5\u5728\u96fb\u8166\u6216\u96fb\u8166\u8caf\u5b58\u9ad4\u5167\u52a0\u5165\u65b0\u7a0b\u5f0f\u6216\u65b0\u6578\u64da\u3002<\/p>\n<p>\u5373\u4f7f\u5efa\u7bc9\u7269\u5167\u6c92\u6709\u6771\u897f\u88ab\u5077\uff0c\u5167\u88e1\u7121\u4eba\u53d7\u50b7\uff0c\u6216\u5167\u88e1\u6c92\u6709\u6771\u897f\u906d\u5230\u7834\u58de\uff0c\u4f46\u53ea\u8981\u80fd\u8b49\u660e\u4fb5\u5165\u8005\u5728\u64c5\u95d6\u5efa\u7bc9\u7269\u7684\u4e00\u523b\uff0c\u6709\u610f\u5077\u7aca\u3001\u50b7\u5bb3\u4ed6\u4eba\u81f4\u56b4\u91cd\u53d7\u50b7\u3001\u4f01\u5716\u5f37\u59e6\u6216\u975e\u6cd5\u640d\u6bc0\u8ca1\u7269\uff0c\u4ea6\u7b97\u662f\u5165\u5c4b\u72af\u6cd5\u3002\u5018\u82e5\u8a72\u4eba\u58eb\u5df2\u7d93\u4fb5\u5165\u5efa\u7bc9\u7269\u6216\u5728\u5efa\u7bc9\u7269\u5167\u7684\u90e8\u4efd\uff0c\u5077\u7aca\u6216\u4f01\u5716\u5077\u7aca\uff0c\u5c0e\u81f4\u6216\u4f01\u5716\u5c0e\u81f4\u4ed6\u4eba\u56b4\u91cd\u53d7\u50b7\uff0c\u4ea6\u89f8\u72af\u5165\u5c4b\u72af\u6cd5\u7f6a\u3002<\/p>\n<p>\u82e5\u6709\u4e00\u540d\u7e8f\u64fe\u8005\u9032\u5165\u53d7\u5bb3\u4eba\u55ae\u4f4d\uff0c\u610f\u5716\u5077\u7aca\uff0c\u4fbf\u7b97\u72af\u4e86\u5165\u5c4b\u72af\u6cd5\u3002\u540c\u6a23\u5730\uff0c\u9032\u5165\u55ae\u4f4d\u5f8c\u610f\u5716\u9032\u884c\u975e\u6cd5\u640d\u58de\uff0c\u4ea6\u7b97\u5165\u5c4b\u72af\u6cd5\uff0c\u8209\u4f8b\u8aaa\uff0c\u7e8f\u64fe\u8005\u64c5\u9032\u53d7\u5bb3\u4eba\u55ae\u4f4d\uff0c\u5728\u5c0d\u65b9\u7684\u7246\u4e0a\u5beb\u4e0b\u8a0e\u597d\u6216\u5a01\u5687\u6027\u5b57\u53e5\uff0c\u4ea6\u5c6c\u72af\u6cd5\u3002<\/p>\n<p>\u7136\u800c\uff0c\u82e5\u4efb\u4f55\u4eba\u9032\u5165\u4ed6\u4eba\u55ae\u4f4d\u53ea\u70ba\u7559\u4e0b\u9810\u5148\u6e96\u5099\u7684\u8a0a\u606f\uff0c\u4e26\u4e0d\u7b97\u5165\u5c4b\u72af\u6cd5\u3002\u4f8b\u5982\uff0c\u7e8f\u64fe\u8005\u9032\u5165\u53d7\u5bb3\u4eba\u55ae\u4f4d\u5167\uff0c\u5728\u5c0d\u65b9\u7684\u9910\u684c\u4e0a\u7559\u4e0b\u5b57\u689d\uff0c\u8aaa\u660e\u66fe\u7d93\u5230\u904e\u6b64\u8655\u3002\u53e6\u5916\uff0c\u7e8f\u64fe\u8005\u95d6\u5165\u53d7\u5bb3\u4eba\u55ae\u4f4d\u5f8c\uff0c\u53ea\u662f\u56db\u5468\u8996\u5bdf\uff0c\u4e86\u89e3\u53d7\u5bb3\u4eba\u662f\u5426\u6709\u65b0\u6200\u60c5\u6216\u8207\u65b0\u7684\u4f34\u4fb6\u540c\u5c45\uff0c\u4e5f\u4e0d\u7b97\u662f\u5165\u5c4b\u72af\u6cd5\u3002<\/p>\n<p>\u5047\u82e5\u4efb\u4f55\u4eba\u64c5\u9032\u4ed6\u4eba\u5730\u65b9\uff0c\u7559\u4e0b\u7684\u4e0d\u53ea\u662f\u9810\u5148\u6e96\u5099\u7684\u8a0a\u606f\uff0c\u800c\u662f\u5728\u5efa\u7bc9\u7269\u7246\u4e0a\u5beb\u4e0b\u611b\u7684\u5ba3\u8a00\uff0c\u7531\u65bc\u5857\u9d09\u7246\u8eab\u5c6c\u5211\u4e8b\u6bc0\u58de\uff0c\u64c5\u9032\u8a72\u8655\u7684\u4eba\u540c\u6642\u4ea6\u5e72\u72af\u4e86\u5165\u5c4b\u72af\u6cd5\u3002\u5211\u4e8b\u6bc0\u58de\u7684\u5b9a\u7fa9\uff0c\u4e26\u4e0d\u4e00\u5b9a\u8981\u69cb\u6210\u6c38\u4e45\u640d\u58de\u3002\u5373\u4f7f\u7246\u4e0a\u7684\u8a0a\u606f\u88ab\u62b9\u8d70\uff0c\u7246\u8eab\u7684\u7279\u8cea\u5df2\u906d\u5230\u6539\u8b8a\uff0c\u6240\u4ee5\u4ea6\u7b97\u662f\u5211\u4e8b\u6bc0\u58de\u3002<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>[et_pb_section
