\u70ba\u4e86\u907f\u514d\u627f\u64d4\u67d0\u4e9b\u8cac\u4efb\u6216\u525d\u524a\u6d88\u8cbb\u8005\uff0c\u67d0\u4e9b\u96f6\u552e\u5546\u6216\u670d\u52d9\u4f9b\u61c9\u5546\u6703\u5728\u5408\u7d04\u4e2d\u52a0\u5165\u514d\u8cac\u689d\u6b3e\u6216\u4e0d\u516c\u5e73\u689d\u6b3e\u3002\u5982\u679c\u56e0\u5546\u6236\u758f\u5ffd\u800c\u4ee4\u95a3\u4e0b\u53d7\u50b7\u6216\u5c0e\u81f4\u8ca1\u7269\u640d\u5931\uff0c\u6cd5\u5f8b\u6703\u8a2d\u6cd5\u5236\u6b62\u4ed6\u5011\u9003\u907f\u61c9\u6709\u7684\u8cac\u4efb\uff0c\u5373\u4f7f\u5408\u7d04\u5305\u542b\u63aa\u8fad\u5de7\u5999\u6216\u5b57\u9ad4\u7d30\u5c0f\u7684\u689d\u6b3e\uff0c\u4ed6\u5011\u4ecd\u9808\u4f5c\u51fa\u8ce0\u511f\u3002<\/p>\n
\u514d\u8cac\u689d\u6b3e\u53ef\u4ee4\u67d0\u4e00\u65b9\u65bc\u4e8b\u60c5\u51fa\u932f\u6642\u4e0d\u9808\u627f\u64d4\u8cac\u4efb\u3002\u5982\u679c\u5546\u6236\u6253\u7b97\u4ee5\u9019\u7a2e\u689d\u6b3e\u907f\u904e\u6d88\u8cbb\u8005\u7684\u7d22\u511f\uff0c\u8a72\u689d\u6b3e\u5fc5\u9808\u5408\u7406\uff1b\u5982\u88ab\u8b49\u5be6\u70ba\u4e0d\u5408\u7406\uff0c\u6709\u95dc\u514d\u8cac\u689d\u6b3e\u4fbf\u53ef\u80fd\u7121\u6548\u3002<\/p>\n

\u2026\u2026\u4e00\u6982\u4e0d\u8ca0\u8cac\u4efb\u300d\uff0c\u4ed6\u5011\u4ea6\u4e0d\u80fd\u514d\u9664\u66ff\u9867\u5ba2\u770b\u7ba1\u8ca1\u7269\u7684\u8cac\u4efb\u3002\u5982\u679c\u9867\u5ba2\u8a8d\u70ba\u8a72\u544a\u793a\u4e0d\u5408\u7406\uff0c\u53ef\u8cea\u7591\u5176\u5408\u6cd5\u6027\uff0c\u800c\u6cd5\u5ead\u6703\u4f5c\u51fa\u6700\u5f8c\u7684\u88c1\u6c7a\u3002<\/p>\n \u300a\u00a0\u4e0d\u5408\u60c5\u7406\u5408\u7d04\u689d\u4f8b<\/a>\u00a0\u300b\uff08\u00a0\u7b2c458\u7ae0<\/a>\u00a0\uff09\u53ea\u9069\u7528\u65bc\u552e\u8ce3\u8ca8\u54c1\u6216\u63d0\u4f9b\u670d\u52d9\u7684\u5408\u7d04\uff0c\u4e14\u7acb\u7d04\u7684\u5176\u4e2d\u4e00\u65b9\u662f\u6d88\u8cbb\u8005\u3002\u5982\u679c\u6cd5\u5ead\u88c1\u5b9a\u8a72\u5408\u7d04\u6216\u5176\u4e2d\u4efb\u4f55\u90e8\u5206\u5728\u7acb\u7d04\u6642\u7684\u60c5\u6cc1\u4e0b\u5df2\u5c6c\u4e0d\u5408\u60c5\u7406\uff08\u4ea6\u5373\u4e0d\u516c\u9053 \/ background_size=\"initial\" background_position=\"top_left\" background_repeat=\"repeat\" hover_enabled=\"0\" sticky_enabled=\"0\"]<\/p> In order to avoid certain liabilities, or to exploit customers, some sellers or service suppliers may insert exemption clauses into their contracts or impose unfair terms. The law tries to stop traders from avoiding their responsibilities to the customers if they are injured or their property is lost or damaged because those traders failed to take proper care. The traders cannot hide behind cleverly worded clauses or a few lines of small print in a contract. They can still be liable to pay compensation.<\/p> An exemption clause is used to avoid liability when things go wrong. Such a clause has to be \"reasonable\" before a trader can rely on it to avoid a claim brought against him\/her by a consumer. In other words, the relevant exemption clause may have no effect if it is proved to be unreasonable .<\/p> The reasonableness test is satisfied if the judge concludes that the relevant exemption clause was fair and reasonable having regard to the circumstances which were, or ought reasonably to have been, known to or in the contemplation of the parties when the agreement was made (\u00a0section 3(1)<\/a>\u00a0of the\u00a0Control of Exemption Clauses Ordinance<\/a>\u00a0,\u00a0Cap. 71<\/a>\u00a0of the laws of Hong Kong).<\/p> In considering what is \"reasonable\",\u00a0schedule 2<\/a>\u00a0of the\u00a0Control of Exemption Clauses Ordinance<\/a>\u00a0provides the following guidelines:<\/p> Under normal circumstances, traders cannot escape from liability arising from the death or personal injury of a consumer if the incident happened due to the traders' negligence (for legal proceedings relating to person injury or death, please go to\u00a0\"Personal Injuries\"<\/a>\u00a0under the CLIC website).<\/p> Example<\/strong><\/p> If a restaurant loses or damages property that you deposited in their cloakroom, they must prove that they have already taken reasonable care of it. They cannot simply put up notices saying something like \"The management does not accept any responsibility... \" and then expect to escape from any sort of obligation to look after your property. You can challenge notices like that, if you think that such notices are unreasonable. It rests with the Court to make the final decision.<\/p> The\u00a0Unconscionable Contracts Ordinance<\/a>\u00a0(\u00a0Cap. 458<\/a>\u00a0) only applies to a contract for the sale of goods or supply of services in which one of the contracting parties is dealing as a consumer. If the Court finds out that the contract or any part thereof was unconscionable (unfair\/not sensible) in circumstances relating to the contract at the time when it was made, the Court would have the jurisdiction under\u00a0section 5<\/a>\u00a0of the\u00a0Unconscionable Contracts Ordinance<\/a>\u00a0to refuse to enforce the contract, or to enforce the remainder of the contract without the unconscionable part, or to limit the application of, or to revise or alter, any unconscionable part so as to avoid any unconscionable result.<\/p> When deciding whether or not the contract or any part of is unconscionable, the Court will consider the following points according to\u00a0section 6<\/a>\u00a0of the\u00a0Unconscionable Contracts Ordinance<\/a>\u00a0:<\/p> Example<\/strong><\/p> A case about the sale of a hotel\/resort service membership was heard in the Small Claims Tribunal in 2002 in which an \"unconscionable\" consumer contract was cancelled by the Tribunal.
