XII. Privacy – Closed Circuit Television

Perhaps you or your neighbours have installed or are considering installing closed circuit television (CCTV) at the entrance to your flat to monitor the doorway for security reasons. Keep in mind that the operation of a CCTV may contravene the Personal Data (Privacy) Ordinance (Cap. 486) if the CCTV captures excessive images of individuals or information relating to individuals.

The Office of the Privacy Commissioner for Personal Data has issued a guidance note on CCTV surveillance practices called “Guidance on CCTV Surveillance and Use of Drones” to advise whether CCTV should be used and how to use it responsibly, and to help the public to understand some of the requirements under the Ordinance relating to the collection and proper handling of the personal data.
